Which civilised liberties should be offered in time of war and to who has been a question which plagues those in potence during national crisis. Through tale and during national wars, civil liberties have been taken from the people or certain people for the excuse quelling dissent, silencing criticism of governmental decisions and preserving national security. A dissent to these decisions is felt as legion(predicate) believe a sacrifice of liberty for security is an unimaginable trade. I will contend in this paper, the issue of hang civil liberties will wait as long every one nation exists, and the parameters of what is allowed and what is acceptable will also continue to morph along with the varying circumstances which threaten a nation as a whole.
History has shown politicians are rapid to act, in time of national crisis, to acquire new authority which often suspends civil rights of the nation. The courts are then left to end a real or perceived national crisis and condition whether the nation’s leaders acted appropriately in fetching civil liberties. Often the courts are reluctant to interfere and civil liberties taken remain in that state until the conflict is over.




In 1798, the Alien and Sedition Acts were drafted which made it a crime to “write, print, carry or publish” any “false, scandalous and malicious report or writings against the government of the join States, or each house of the Congress of the United States or the president of the United States.” These acts, considered by some, violated the constitution by limiting exemption of speech and of the press as put forth in the first amendment to the Constitution. President Lincoln also interfered with these rights by rules of place suspected political criminals to be tried before force tribunals.
