History has shown politicians are rapid to act, in time of national crisis, to acquire new authority which often suspends civil rights of the nation. In 1798, the Alien and Sedition Acts were drafted which made it a crime to “write, print, carry or publish” any “false, scandalous and malicious report or writings against the government of the join States, or each house of the Congress of the United States or the president of the United States.” These acts, considered by some, violated the constitution by limiting exemption of speech and of the press as put forth in the first amendment to the Constitution. President Lincoln also interfered with these rights by rules of place suspected political criminals to be tried before force tribunals.
